Legal advise, NYC Real Estate
In the beginning of the year I found a co-op in Riverdale, Bronx, and decided to purchase it. I gave the downpayment as the deposit and began to secure the mortgage. Unfortunately, the broker I was working with was very slow and I could not secure the loan in 1 month (allotted by the contract). My attorney sent them a request for extension, however, they didn’t reply to the letter officially, but kept pushing me through their real estate agent. I had to switch brokers and start the process again. To make matters worse, the banks declined my mortgage application. Well, I thought: “Maybe next time,” and proceeded to retrieve my deposit. However, the seller doesn’t want to return it. I have an attorney, and he says that what they are doing is illegal, but my only option is to take them to court, which will cost time and money. I assume, he does not want to deal with it. He only signed up to do the closing and not litigation. Are there any governmental agencies that can help? If not, can anyone recommend a respectable real estate litigation lawyer? Thank you
