Нами был подписан лиз (приведен в конце).
Приехали, 3 дня отдохнули, в самом конце прибрались, загрузили в последный раз посудомойку, собрали из дома весь мусор (включая ванные). Запаковали весь мусор за три дня в мусорные мешки, посмотрели нет ли каких специальных упоминаний куда этот мусор девать, не нашли - и вынесли мешки к обочине дороги.
Через три дня, получаем e-mail:
I just received a call from Towamensing Trails regarding a $250.00 fine for 9 trash bags being left out on our deck. Your security deposit was $200.00 so I would appreciate a check in the amount of $50.00 to be sent to me ASAP. I will send you a copy of the fine. As you know there is plenty of wild life in the Pocono's and it made quite a mess of our property along with an eye soar for the neighbors. Trash belongs in the dumpster provided by T.Trails.
Платить, естественно, не хочется, тем более что хозяйка не говорил о мусоре ничего, в доме инструкций на этот счет не было, ну и наконец в лизе мы конкретно под вынос мусора куда-то за не рядом с домом мы не подписывались.
Очевидно, что ситуация двойственная: с нашей стороны недопонимание, как мы вообще могли знать, что нужно делать с мусором, а значит ни в чем не виноваты. Со стороны хозяйки вроде как штраф на $250 долларов вот он, и мусор "сгенерирован" и не вынесен нами - понятно кто виноват. Явно дело для small claims court.
Ну мы, конечно, сразу слабали ответец (e-mail):
We are sorry to hear that you got fined because of the trash bags left on your deck. We really enjoyed our stay in your house and it is very sad that this incident had happened.
However, we don’t agree that this is our fault, because we have not heard a single word from you about how to dispose garbage and we didn’t find any note in the house about this matter.
As we did complied to the rules of the lease agreement, we would like to receive the refund of our deposit in sum of $200 no later than in 30 day as stated by the Pennsylvania law.
We’re also ask you to address further correspondence by mail, to
ZZZ3

There is a note posted on the refrigerator regarding the rules. Not only did we get fined but we also have a cleaning bill for $65.00. The dishwasher was left full, bathrooms were not clean, hardwood floors were not cleaned. So, it cost us money to have you stay at our home. We expect our tenants to respect our home and leave in the same order it was found. Not leave their trash. I'm sure you would not want nine bags of trash left on your property for animals to tear thru. I'm sorry but I have no choice to keep your security, and as I said the fine was $250.00 and the cleaning charge is $65.00. I hope you will do the right thing and send the difference of $115.00.

2) Какие вопросы могут возникнуть у судьи, что на них отвечать
3) Собираемся на днях послать 'почтовое' письмо by certified mail, чтобы расставить все точки, и означить ей свои намерения пороться за депозит в суде (со дня окончания лиза прошло 23 дня). В суд идти не хочется, поэтому письмо нужно написать максимально убедительное.
4) Годятся ли e-mails для суда? Или она должна прислать itemized претензии по почте?
5) Могу лия подать в суд один, без жены? Спрашиваю, потому что лиз подписывала моя жена (YYY), но в лиз включен и я (плюс все 8 человек, которые были в доме). Депозит слупили получается с нас двоих, тк банковский счет у нас один.

RENTAL LEASE
This lease is between XXX, owner and YYY tenant, for ZZZ1, Towanemsing Trails, PA. The tenant agrees to lease this dwelling for a term of 3 days, beginning FROM and ending TO for $550.00, payable in advance by the first day of the lease period.
A damage deposit of this dwelling of $200.00 is refundable if tenant complies to this lease and leaves the dwelling clean and undamaged and has no outstanding Trails violations. Rent and deposits shall be paid in cash or check only in advance, to XXX. Payments shall be mailed to ZZZ2. The owner will refund all deposits due within 30 days after the tenant has vacated the property and returned all keys.
Only those persons specified on the Rental Application may stay at the property, and no pets shall be admitted to the dwelling even temporarily. The dwelling may not be sublet or used for business purposes. No smoking of any kind is allowed in the house. All appliances included in the rent are for use at the tenant-s own risk. No discharging paintball guns of any kind on property.
Then tenant agrees to the terms set forth in attached rental policy. This attached rental policy shall be considered a part of this lease and the tenant-s signature on this lease indicates his or her acceptance of all terms and conditions of the rental policy.
Violation of any part of this agreement, or nonpayment of the rent when due, shall be cause for eviction under appropriate sections of the applicable code or law. The owner reserves the right to seek any legal means to collect moneys owed to him or her. The prevailing party shall recover reasonable attorney fees incurred to settle disputes. The tenant herby acknowledges that he or she has read this agreement, understands the entire document, and has been given a copy of the agreement.

I’ve mailed the lease and checks. Could you send me rental policy mentioned in the agreement? 'Then tenant agrees to the terms set forth in attached rental policy'.
Хозяйка:
There is not another rental policy, it just applies to the rental lease.
