H1->H1 глобальная проблема (help!!!! )

Я писал это в visa поэтому кидаю без перевода
I am a H1b Visa holder but my current employer is not willing to invite me. I found the new employer and they filed the petition to INS for new approval. Yesterday I found out that I am subject to a new quota. Although I have not recieved the answer from INS yet my employer said that I am out of quota and the approval will be rejected. Could anyone please answer the following questions in connection with my situation:
1. What is the procedure with the approval. Will it be rejected on the basis that the quotas are over or its consideration
postponed till the new quotas are open. I heard that you still can get the approval and even visa at the consulate but there will be a stamp on it that you can enter only after October, 1 (when new quotas are open). Is that correct?
2. What are possible ways out?
Well, is it possible to enter U.S. and file the new petition again in case my future employer is willing to pay for my stay
during the period of document's consideration. Will it be legal to file the new petition right after the first was not
satisfied or postponed or whatever it may be with it (see my first question). What are the chances that I will have problems while entering and then during my stay providing my current employer is not notified about it. Will I be in status in case my documents are filed for a new approval?
I am sure that my current employer is a dead variant and is not going to invite me at all so I will not hurt his feelings in case I change the employer.

So, his first H1 should be counted as an unused H1 and he second will make it into the next quota only.
transfer is possible only if he had started working for the first employer.
Кстати что такое unused H1 и когда он будет обратным - при везде в страну или при начале работы (эмплоер наверно подает какое то извещение ?)И вот еще мои документы поданы
15.04.99 в NSC.Есть ли шанс получить сейчас а не в октябре ?

Тебе перевод нужен, да? Понимаешь, мне тут не пальцы кидать а с реальной проблемой справиться, вот я и обращаюсь к коллективному разуму. Был бы в штатах, адвоката нанял...

Почитай это на счет квоты

Если у тебя есть петиция I-797, отпавь копию своему емпл., пусть подадут на трансфер. Можеш почитать мою историю в Работа. На сколько я знаю никто не подает никаких данных в INS. А у INS и так работы хватает, что бы еще отслеживать кто работает по H1, а кто нет.
