Вообще кто-нибудь задумывался над вопросом, почему нормальные страны не имеют 90% ного налогооблажения высоких доходов? Ведь идея такая привлекательная, много денег в казну, социальная справедливость и все такое. Ответ на этот вопрос дает Laffer Curve. Выше определенной точки высокие налоги дают бегство капитала, уход от налогов и меньшую инициативу для работы и инвестиций. Что приводит к меньшей сумме собранных налогов. С высокими налогами баловались многие страны, в том числе США в середине прошлого века. Когда Рейган снизил налоги на "богатеньких" выяснилось что количество собранных с них налогов в долларовом выражении сильно увеличилось. Страны типа Сингапура очень сознательно выбирают невысокую налоговую ставку - это позволило им быстро развить экономику и сильно увеличить сумму собираемых налогов

Dude, Laffer curve?! CEOs' marginal tax rate is lower that their secretaries and its nowhere near 90%, 60% or 40% (hint: think stock based compensation and preferential treatment of capital gains versus regular income).
At this point brining up Laffer curve makes absolutely no sense.

Really? OK, so let's assume that John is CEO. Company pays him 1M in salary and 2M in shares. Are you saying that those 2M will be taxed as capital gains?

Я вот имею доход и там и тут. Плачу налог и там и тут. Когда в штатах плачу, то прикладываю копию своей российской декларации. В РФ ничего не прекладываю, у нас ето определяется не гражданством, а резиденством и доходм в стране или нет.

Here is an explanation of how you can have your compensation (which is what stock options are in this case) taxed as long term capital gain @ 15% capital gains tax rate.

Исходя из этого примера, видно что платить capital gains tax можно только при соблюдении кучи условий, которые от CEO слабо зависят
1. Надо ждать больше двух лет
2. Сток не падает
3. Регуляции в течение двух лет не изменятся на эту тему
4. В статье "удобно" опустили AMT, который усложняет всю эту картину и заставит платить больше

How do you know that it's 15% if you don't take AMT into account at all? AMT is the law, you know. You can't just dismiss it
Т.е. нашему CEO заплатили 2М этими ISO сегодня. Никто точно не знает сколько он заплатит на них налога. Известно только что этот процент будет не меньше 15%. Это при условии что от этих ISO останется хоть что-то через 2 года.
Эта схема является каким-то ужасным геморроем. Куда нужно еще и свои деньги вкладывать для покупки shares. Многие люди предпочли бы заплатить regular налог и получить деньги сразу, вместо участия в этой мутной и неопределенной схеме, которая скорее всего имеет еще и vesting conditions

Откуда ты взял цифру налога на ISO compensation в 15%? Баффета не надо путать с обычными СЕО, потому что Баффет - инвестор, в отличие от обычного СЕО.

Нет не инвестором. Нормальный инвестор может покупать и продавать в любой момент и платить capital gains на доход безо всяких законодательных ограничений и vesting rules.
